En 1978, la Ley sobre Discriminaci\u00f3n por Embarazo (PDA, por sus siglas en ingl\u00e9s) fue enmendada a la Ley de Derechos Civiles especificando que el embarazo, el parto o las condiciones m\u00e9dicas relacionadas ca\u00edan dentro de la categor\u00eda de discriminaci\u00f3n sexual descrita por <b>T\u00edtulo VII de la Ley de Derechos Civiles<\/b>. Para que se establezca una pr\u00e1ctica laboral ilegal, usted debe poder <a href=\"\/es\/areas-de-practica-2\/abogado-de-discriminacion-por-embarazo-2\/\">demostrar que una discriminaci\u00f3n espec\u00edfica basada en su embarazo<\/a>, parto o condici\u00f3n m\u00e9dica relacionada ocurri\u00f3 y no estuvo relacionada con el trabajo. <\/p>\n<h2>Ley de licencia por maternidad en California: una gu\u00eda sobre los derechos de las madres<\/h2>\n<p><b>La Ley de Vivienda y Empleo Justo de California<\/b> (FEHA) es un estatuto de California para la discriminaci\u00f3n laboral. Si bien tanto las leyes estatales como las federales se aplican a hijos, padres y c\u00f3nyuges, la CFRA extiende su jurisdicci\u00f3n a las parejas de hecho y a los suegros. <\/p>\n<p>Seg\u00fan una nueva ley que entr\u00f3 en vigor en 2018, el <b>Ley de licencia parental<\/b> (PLA), las mujeres est\u00e1n protegidas contra el despido por tomar una licencia de maternidad y pueden utilizar cualquier tiempo libre remunerado o licencia por enfermedad remunerada acumulados. Los criterios para ser protegidos bajo el PLA reflejan los de la FMLA. Debe haber trabajado en la empresa durante al menos un a\u00f1o, debe haber trabajado al menos 1250 horas durante ese a\u00f1o y debe vivir dentro de un radio de 75 millas del lugar de trabajo. Ampliando su alcance, una empresa califica bajo el PLA si tiene entre 20 y 49 empleados, mientras que la FMLA solo cubre empresas con 50 o m\u00e1s empleados.
